MLS Research Seminar
On March 13, Macquarie Law School hosted Associate Professor Allison Silink who presented her research as part of the MLS Research Seminar Series for 2024.
Associate Professor Silink analysed in a very engaging way the interpretation and application of s 249E of the Crimes Act 1900 (NSW), which has been recently construed by the Supreme Court of New South Wales as applying in the absence of any dishonest or corrupt intention.
The presentation critically discussed how this construction leads to the criminalisation of routine commercial practice, particularly for large managed investment schemes and superannuation funds.
